Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Noma Intel platform (the “Service”), operated by Meerkat Media Ltd (ABN 56 680 260 271), of Level 3, 223 Liverpool St, Darlinghurst NSW 2010, Australia (“we”, “us”). By using the Service you agree to these Terms.

1. The Service

Noma Intel is a business analytics and reporting platform that presents website analytics, AI-visitor visibility, and connected advertising-platform performance data to agencies and their clients. The Service is provided to business users, not to consumers.

2. Accounts and access

• Access is by invitation through an agency. You are responsible for keeping your sign-in credentials secure and for activity under your account.
• You must have authority to connect any advertising or analytics account you link to the Service, and to permit us to access its data for reporting.
• You must not attempt to access data belonging to clients or agencies you are not authorised to see.

3. Acceptable use

You agree not to:

• use the Service unlawfully or in breach of a third party’s rights;
• attempt to disrupt, reverse engineer, or gain unauthorised access to the Service or its underlying systems;
• use the Service to store or transmit malicious code.

4. Connected platforms

When you connect a third-party account (such as Google Ads or Meta), your use of that platform remains subject to that platform’s own terms. Our handling of data obtained through those platforms is described in our Privacy Policy and API data-use disclosure. You may disconnect a connected account at any time.

5. Data ownership

As between you and us, the analytics and advertising data belonging to an agency or client remains theirs. We process it to provide the Service as described in the Privacy Policy. We retain ownership of the Service itself, including its software and design.

6. Availability and changes

We aim to provide a reliable Service but do not guarantee uninterrupted availability. We may modify, suspend, or discontinue features, and we may update these Terms; continued use after a change constitutes acceptance.

7. Disclaimers and liability

The Service is provided “as is”. To the extent permitted by law, we exclude implied warranties and are not liable for indirect or consequential loss. Nothing in these Terms excludes rights that cannot lawfully be excluded, including under the Australian Consumer Law where it applies.

8. Termination

We may suspend or terminate access for breach of these Terms. You may stop using the Service at any time. On termination, provisions that by their nature should survive will continue to apply.

9. Governing law

These Terms are governed by the laws of New South Wales, Australia, and the parties submit to the courts of that jurisdiction.
